Moderation: We may, but are not obligated to, review, monitor, or remove User Content at our discretion.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZPHC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

WITHOUT LIMITING THE FOREGOING, ZPHC’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO ACCESS THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15) Indemnification

You agree to defend, indemnify, and hold harmless ZPHC and its affiliates, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

16) Suspension & Termination

We may, at our sole discretion and without liability, suspend or terminate your access to the Services at any time, with or without notice, including for any breach of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease.

17) Changes to the Services & to These Terms

We may modify or discontinue any part of the Services at any time. We may also update these Terms by posting a revised version and updating the “Last Updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

18) Governing Law, Arbitration & Class Action Waiver

  • Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign these Terms without our prior written consent; we may assign them without restriction.
  • Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices: We may provide notices via email, within your account, or by posting to the Services.
